1. Acceptance
These Terms of Service (the "Terms") govern access to and use of the website umaru.fun (the "Site"). By accessing the Site or creating an account, you accept these Terms and the Privacy Policy. If you do not accept them, do not use the Site.
2. Eligibility
You must be at least 13 years old, or older if the law of your country sets a higher age for using online services, and legally capable of entering into these Terms. Adult content on the Site is marked 18+; do not view it if you are under 18. You may hold no more than one account.
3. Accounts
- Your nick must be 3 to 20 characters long and may contain a-z, 0-9,
_and-. Your password must be at least 8 characters long. - You are responsible for keeping your password confidential and for all activity performed under your account.
- Accounts have no email address, and password recovery is not possible. We cannot restore access to a lost account.
- We may suspend or terminate an account under Section 7.
4. Your content
- You retain ownership of the content you post.
- By posting content, you grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and distribute that content within the Site, and to make technical copies (caches, backups) necessary to operate it. The licence ends when the content is deleted, except for residual backup copies.
- You represent that you own or control all rights to the content you post, that it does not infringe the rights of any third party and that it does not violate applicable law.
5. Prohibited content and conduct
You must not post or do any of the following:
- content that is unlawful in your country or in the country where the server is located;
- child sexual abuse material (CSAM). There is zero tolerance: such content is deleted and reported to the competent authorities;
- content that infringes copyright, trademarks or other rights of third parties;
- personal data or private photos of other people without their consent;
- threats, harassment or targeted abuse;
- spam, mass advertising, referral schemes, malware or phishing links;
- impersonation of another person or of the administration;
- adult content without a clear 18+ mark in the title;
- circumventing rate limits, bans or other restrictions, and automated scraping of the Site.
6. Moderation
We may remove or edit any content, lock any board or thread, and suspend or ban any account, with or without notice, where we consider it necessary to protect the Site, its users or third parties. We are not obliged to monitor content posted by users and, to the extent permitted by law, are not liable for it. Users are responsible for their own content.
7. Copyright complaints
If you believe that your rights are infringed, send a notice to [email protected] containing: your contact details; identification of the protected work; the exact URLs of the disputed content; confirmation of your rights or a statement of good faith; and your signature or equivalent. We will remove or block the disputed content and may notify its author. Accounts of repeat infringers may be terminated.
8. Advertising
The Site displays third-party advertising. We do not control and are not responsible for the content, products or services of advertisers, or for the terms of advertising networks.
9. Disclaimer of warranties
The Site is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted, error-free or secure operation, or that any data will be preserved.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profit or goodwill. Our aggregate liability under these Terms is limited to the amounts, if any, that you have paid to the Site in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold harmless the operator of the Site against claims, damages and expenses (including reasonable legal costs) arising from your content or your breach of these Terms.
12. Termination and deletion
You may request deletion of your account or content at any time by writing to [email protected]. We may terminate these Terms with you, and may discontinue the Site or any part of it, at any time.
13. Governing law and disputes
These Terms are governed by the law of the jurisdiction in which the operator of the Site is established, without regard to conflict-of-law rules. Before going to court, you agree to attempt to resolve the dispute informally by contacting us at [email protected].
14. Changes
We may amend these Terms. The current version is published on this page with its effective date. Material changes are announced on the Site. Continued use of the Site after the effective date constitutes acceptance of the amended Terms.
15. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions stay in force. These Terms together with the Privacy Policy constitute the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of it.
